"Could you please tell me what I did wrong?"
Yesterday (13 April) around 9.30am, I posted my opinion why "I cannot accept the draft constitution" on my Facebook page. The gist of my comment on the draft constitution is as follows.
Currently the draft constitution is undergoing a referendum. All parties including the political parties should have freedom of opinions either supportive or against. I disagree with the reaction of the Prime Minister and the Commander in Chief, Royal Thai Army, who has expressed a strong dissatisfaction over the statements made against the draft constitution by two major political parties.
At 2.30pm on the same day, I was contacted by a military that the order to arrest me due to my aforementioned online opinion posting was out. I informed that military politely that this is the Songkran holiday or the Thai new year, the biggest holiday season of Thailand, I will be able to be back home and get arrested on Monday 18 April at 11am.
Giving opinion on the draft constitution, for or against, is considered the right and freedom of the Thai citizens according to article 4 of the Interim Constitution of the Kingdom of Thailand. While the Prime Minister and the Commander in Chief, Royal Thai Arm has expressed a supportive opinion for the draft constitution, the Thai citizen including myself shall be able to also suggest a different and opposing view against it. Moreover, before my online posting on my opinion not to accept this draft constitution, other political parties namely; Phue Thai and Democratic Party, have already revealed their position rejecting this draft constitution. I firmly believe that the opinion to turn down the draft constitution is legitimately well within the scope of freedom and right of expression and opinion. I didn't violate any legislation. I am strongly dissatisfied with the arrest by the military in a so-called "attitude adjustment."
Referring to the command of the National Council for Peace and Order (NCPO) of 3/2015, a military from the second lieutenant upward, deemed "officer maintaining peace and stability" has power to summon 4 types of suspects for an investigation and/or detention for a maximum of 7 days: 1) lèse majesté 2) offense against the internal security of the state 3) offensive weapons and 4) violation of the declaration or command of the NPCP or the head of NPCO.
I, however, fully trust that my online posting expressing my opinion to reject the draft constitution during its referendum period does not violate the aforementioned (1)-(4). Therefore, my action does not to fall into the conditions to allow the detention for a maximum of 7 days by NPCO. I would like to plea to be inform of my charge why expressing opposing opinion online is considered a wrongdoing. If my online comment did indeed violate any legislation or NPCO command, why other political parties and academics who express opposing opinions against and rejecting the draft constitution along the same line are free from any charges.
I am made believed once again that NPCO is abusing their "discretionary power," act in a "discriminatory," manner and violate "the basic human rights" of the Thai citizens. I would like to take this opportunity to plea to the people of Thailand, media, honorable embassies and human rights related international organizations to please help check and examine this tendency for power abuse of the NPCO.
