【未能證明其案勿亂告人】
民事官司這回事，經常都有很多的訴訟期，在等待訴訟的過程之時，原告人一方基於可能的損害正在進行，而若不及時阻止答辯一方某些行為，可能對原告人的利益造成不可救回的損害情況，這在需要保護知識產權的案件最明顯。在這情況下，原告人一方可申請臨時禁制令（Interim Injunction）或其他行為，如發出律師信等。
原告人的利益無疑可得到最大保障了。但案件若是最終敗訴，原告人同樣有責任賠償答辯者一方的損失。更清楚的情況是告人一方開庭時發覺原來證據不足，根本未能證明其案（Failure to prove the case）。這一刻等如敗訴，不論理據如何充份，都有責任賠給對方所有損失，包括令被告人失去的生意機會，那可能是天文數字，所以不要隨便告人。

讀者可上網一查，Bratz為有名的時裝玩偶；Funky Tweenz也是。在2001年由於一系列的相似玩偶，原告人MGA準備告被告人侵犯版權。在法律行動開始之前，MGA對Funky Tweenz的買家或潛在買家發出“終止及停止信件”（Cease and desist letters）。買家自然停止入貨這系列的玩偶。
原告人還申請了臨時禁制令，要求答辯的一方交出Funcky Tweenz的鑄模（moulds）並取去顧客的細節資料。
直到2008年3月才安排了案件聆訊的日期，但到了2月尾原告人申請改日期為法院拒絕。在開庭第一天，原告人申請終止訴訟並撤回禁制令。法官准許被告人自由研究賠償的金額。
在5月19日，按被告人申請的指令，法官作出需要給被告人725萬美元的金額賠償，並要另付律師費及利息等。
原告人就這金額上訴並要求新的聆案或只付17萬美金的賠償，爭議之要點是指法官錯誤依靠了被告人的證供並不能分開禁制令與律師信所引起的損害根本不同。
上訴庭除律師及利息的計算外，拒絕了原訴人的上訴申請：
（一） 在評估損失的問題上只有少量證據有關產品在一段貿易之間的情況如何，所以只能依靠一定程度的猜想（Guesswork）在無法有直接比較的情況下，專家不能作保守的估計。以其他同類貿易的情況作比較是合理的。
（二） 雖然申請禁制令一方之後又無法在審訊中證明指控不一定是錯誤一方，但其申請等同作出承諾不會禁制禁令所不應阻止的情況。原則上，需有禁制與失去權益的均稱（Symmetry）作補償，特別是原告人不願提供在禁制令期間得到的貿易得益詳情。
（三） 法庭只能行使廣泛的公義（Broad Justices），若當時可變因素大多無法精估。
（四） 最重要的問題是申索人是否失去了一次賺取金錢的重要時機，若是，則是數額的問題。再審令是不合適的，除非本案有極大錯誤或不公義的情況（a substantial wrong or miscarriage of justice）。◇
