賴芳雄教授:蔡英文是國民黨安插在綠營的木馬?
【民報編者按:賴芳雄教授是台中人,台灣大學畢業,美國堪薩斯州立大學博士,在美國麻薩諸塞大學羅爾分校塑膠工程系擔任教授三十幾年,今年退休(名譽教授)。羅爾分校的塑膠工程專業在全美排名第一,也是美國第一個授予塑膠工程本科學位的大學,賴教授是這方面的資深台灣人學者。他的這篇英文投書給了Taipei Times(台北時報),但不被刊出。對權力者的監督和評論自由是一個國家民主的重要根基。本刊獲得這篇英文後翻譯刊出,以饗讀者。】
我一直很好奇,為什麼關於蔡英文女士的博士學位問題持續了這麼長時間。這個爭議從很多角度來講都是很特別的。從學院的角度來講,這個問題應該早就解決了,因為一個學位(的有無)不是一個模糊不清、模棱兩可、或者會引起歧義的問題。這裡只有一個真實,要麼蔡女士獲得了博士學位,要麼蔡女士沒有獲得。林環牆教授展示了他的調查結果,並且得到了其他教授的佐證(賀德芬教授,徐永泰教授等)。蔡英文女士的一個捍衛者是李敦厚教授 。在典型、正常的教育體制中,應該是蔡女士本人回應這個事件。這是一個一天就可以解決的問題。然而,蔡女士卻指控教授們毀謗,甚至到法院起訴他們。這種情形的回應,在學術界是前所未有、從未聽說過的。
基於如此,對此案唯一合理的理解是:蔡女士的博士學位問題不是一個學術問題,而是一個政治問題。根據她本人、總統府和她的支持者們的回應,我們只能得到一個合理的結論:蔡女士沒有通過正常的、公平合理的學術渠道獲得博士學位。事實上,有一些學位是可以用金錢購買到的。
更值得人們深思的是,我們必須質問,蔡女士為什麼不承認這個事實、了結這件事呢?因為是否有博士學位並不是做中華民國總統的必須條件。事實是,她如果承認這個事實,就會使所謂的 「中華民國」這個虛幻崩潰。30多年以來,國民黨成功地利用了蔡英文這個植入了民進黨的特洛伊木馬。台灣人民被欺騙,而且台灣人民必須承認:國民黨吞享了我們上次大選的午餐(成果)。我第一次被騙,無恥的是你;我被騙第二次,那是我的恥辱。
賴芳雄教授英文投書如下:
Dear Editor,
I have been curious how did the issue of Ms. Ing-wen Tsai's Ph.D. degree has been dragging for such a long time. This controversy is unique in many ways. From the academy standpoint, this issue shall have long been resolved. An academic degree is not an ambiguous issue. There is only one truth, either Ms. Tsai has earned her Ph.D. degree, or she did not earn it. Prof. Hwan Lin has presented the results of his research, supported by other professors (Ho, Hsu, and others). One of her academic defenders is Prof. Lee Tun-Hou. In a typical educational setting, it is up to Ms. Tsai to present her case. The matter can be resolved within a day. Instead, Ms. Tsai was accusing the professors of defamation and sued them in court. This kind of response is unheard of in the academy.
Hence, the only reasonable understanding is that Ms. Tsai's Ph.D. degree is not an academic issue, rather than a political one. Judging from her responses and by her office and supporters, we cannot but reach a reasonable conclusion. Ms. Tsai did not earn her Ph.D. degree through the standard process fair and square. Indeed, some degrees are available for sale.
More significantly, we must ask why Ms. Tsai would not admit the truth and move on, since a Ph. D. degree is not required to be a president of ROC. Her admission of the fact would result in the collapse of the myth of the so-called Republic of China. KMT brilliantly used Ms. Tsai as a Trojan horse in DPP for more than 30 years. The people of Taiwan were duped and must admit that KMT ate our lunch in the last election. . Fool me once, shame on you; fool me twice shame on me.

我已經在台南西港堀仔頭以生態村作為抵抗<西港外環道擋拆大作戰>駐村7天(超開心的這裡:早上張開眼睛在竹林與芭蕉葉之間醒來,走著走著就有樹抱,下午跟好友們一起煮飯揮鋤頭,大家都很愛彼此,也很愛樹。),每天都跟其他藝術家學習怎麼在田裡生活,瞭解植被,學習如何能不輕易浪費資源。如果樹木被砍光了,土壤就跟著貧瘠,再來就不能種田,不能種田之後連土也不能吃,然後國家就會進口農產品,進口當然是要省成本找那種最便宜的,最便宜的當然是最大廠ㄉ,然後進回來之後再說國外的月亮圓要課稅。再來就好像是便宜得賣你,像是地瓜粉一包不到50元,你去買50元的地瓜回來做地瓜粉看看,看你做出多少地瓜粉?然後基改的農場品進來之後,再進國外進口的藥,「哇,米勾進靠欸,啾賀欸,緊來團購幾勒。有健保啦哩嘛多領一些藥。」開診所,假借仁慈之名說要懸壺濟世開醫院,其實啦~D賽叫你沒事多喝水但是也要多看醫生下禮拜還要回診。然後開一些爛學校,讓你現在覺得便利商店跟你說吸管塑膠袋盡量用這樣很正常(以前塑膠袋還不用錢喔,真的有在黑喔),反正你的國家乾淨的能源愈少(乾淨的樹, 清新的空氣, 透徹的水),我的帝國就相對強勢。

Real Democracy in Taiwan in Jeopardy
Taiwan has had a reputation of being a shining light of Democracy in Asia. That reputation has been tarnished in the past 10 years, but the Sunflower Movement, a movement of courageous YOUNG people, gave Taiwanese a sign of hope.
President Tsai Ing-wen’s election victory signaled greater hope for change and progressive policy changes in Taiwan. However, her difficulties have most people in Taiwan doubting the possibility of meaningful change.
What has become more obvious over time is that the leadership, whether KMT or DPP, have all been instrumental in policies and practices that are deemed unfair or unjust to different groups in Taiwan.
As discussed in this recent article in New Bloom Magazine (http://newbloommag.net/.../sigang-tainan-preservation-fest/) conflicts between youth activists has not decreased with the current administration. What the youth of Taiwan sees as injustice continues on every level of government. It may be time to consider significant reform in the way the government works. Without serious reform, politicians can legally appropriate government funding for projects that do little for their communities, but put money in the pockets of their friends and family members. And, this has far greater consequences than the waste of public funds.
I have been following closely a case of forced land appropriation in Sigang District of Tainan City, and have grown to admire the courage and resourcefulness of a growing group of young “tree protectors,” led by TC Cheng. This organic farmer respects his trees that his grandfather planted 80 years ago, and they are one of the few remaining forests in the area, providing a haven for many animal species. He also wants to protect the local culture, including the Japanese railroad line that runs along the proposed highway route. TC wants to protect the natural and cultural identity of the community, before it is wiped out by unnecessary construction.
If you ask the local politicians, the proposed “bypass” highway is important to the local economy, although a closer inspection may cause one to doubt their logic. One thing is likely. Whomever bought the land near the highway site will profit. Unfortunately, these local politicians have been able to have most of the locals buy into their reasons, so local support for protecting the trees has not been strong.
Local community groups and associations have come together to propose a compromise in this case. They have created a new plan for the road development that is not a “bypass” road, but rather a “cultural heritage road,” which will preserve the oldest trees and develop the local culture, so people will WANT TO COME to the community. THAT is what would help the local economy.
But, the local politicians and Tainan City government don’t want to offer the patience to evaluate and consider the plan.
That leaves us with a confrontation. Any confrontation is a risky proposition to the bulldozer drivers, the developers, the police and to the politicians. They all could get bad publicity, which could give Tainan City Mayor Lai a black mark for any upcoming Presidential election.
More importantly, the tree defenders have the qualities of courage and leadership that Taiwan needs. We need to listen to young leaders, not push them aside them for the sake of short-sighted profit. This reporter will do what he can to document the developments, and pray for everyone’s safety.
It seems that is all we have left, when the corrupt, broken system leaves no other alternatives. Please PRAY with me for the safety of these young heroes.
Without government reform, Taiwan will lose its natural habitats, cultural identity, and young heroes for its future generations.

Taiwan is on the verge of becoming the first Asian government to legalize marriage equality. But the public is deeply divided.

In October 2014, a crowd at an LGBT rights rally in Taipei, one of many, lobbed four large red balloons emblazoned with the Chinese characters for marriage equality into the fenced courtyard of Taiwan’s legislature. At that time, a comfortable majority of Taiwanese supported same-sex marriage; a number of polls in the self-governing island of 23 million indicated as much, with one showing as many as 71 percent in favor. But several initiatives to amend the law to achieve marriage equality, first mooted in 2003, have not been successful. Two years later, three marriage equality bills now sit on legislators’ desks; although international media have been quick to announce that Taiwan stands on the cusp of being the first government in Asia to achieve marriage equality, the island’s public seems deeply divided. In the latest poll on the subject, released on Nov. 29, 46 percent of respondents supported marriage equality, while 45 percent opposed it. Meanwhile, Taiwan’s lawmakers and its civil society have been more cautious than recent headlines in Western media suggest.

Island-wide marriage equality initiatives have been unsuccessful in spite of growing support over decades. Even without national legislation, many local governments in Taiwan now allow same-sex couples to participate in collective weddings and to record their partnership in household registries across the island, although neither action confers any legal rights.
過去數十年,即便婚姻平權的支持度越來越高,推動婚姻平權的行動卻屢遭挫敗。雖然中央尚未立法保障同志權益,台灣有許多地方政府已開放同性伴侶參與聯合婚禮並開放同性伴侶註記,然無論是聯合婚禮還是同性伴侶註記,皆未能給予同性伴侶法律上的權利。
To many, the election of President Tsai Ing-wen and her Democratic Progressive Party (DPP) in January portended a broader, deeper change. Tsai openly made statements that appeared to support marriage equality during and after her campaign. In an October 2015 Facebook video posted to coincide with Taipei’s annual LGBT pride parade, Tsai exclaimed, “Everyone is equal before love.” A year later, she posted a photo on her Facebook page showing a rainbow, adding that her “belief has not changed” post-election. In August, Tsai appointed the first transgender official in government, Audrey Tang, as executive councilor for digital policy, which looked like another step toward acceptance of different gender norms.

Yet she has never explicitly promised that her administration would push for same-sex marriage legislation, and critics have feared that once in office, she would find herself unable to follow through on her progressive rhetoric. The party that Tsai leads, the DPP, “has neither devoted sufficient resources to communicate the issues of marriage equality nor to reconcile differences within the party,” Victoria Hsu, who heads the nonprofit Taiwan Alliance to Promote Civil Partnership Rights (TAPCPR), told Foreign Policy.

It was therefore a setback when Justice Minister Chiu Tai-san announced in August that his ministry still intended to introduce its own same-sex partnership bill — but only in 2017, after studying the impact of such a law on Taiwanese society. (In Taiwan, ministries can introduce bills into the legislature.) The effort dates back to the previous, more socially conservative Kuomintang (KMT) administration of Ma Ying-jeou and is an attempt to compromise between supporters of marriage equality and religious groups opposed. Proposing a separate law for same-sex partnership is politically easier, as it leaves the institution of marriage as currently constituted unchanged.

In the absence of strong top-down leadership on the issue from Tsai, momentum for the bills currently under consideration has come from the bottom up. Audrey Ko, the chief editor of Womany, an online media outlet focused on gender issues and LGBT rights, says a stigma remains for gays and lesbians in Taiwan, one her company seeks to dispel. Other organizations, such as the Taiwan Tongzhi (LGBT) Hotline Association, perform peer counseling and advocacy work. Even corporations are chipping in; in March, McDonald’s released a commercial in which a son comes out to his father in one of its restaurants. (The father accepts it.)

This summer, a number of Taiwanese pop artists organized a benefit concert to raise awareness for marriage equality; tickets sold out in minutes. Pop superstar Jolin Tsai performed a lesbian-themed song for the occasion. In the music video for the song “We’re All Different, Yet the Same,” she makes the case for marriage equality by describing the plight of a woman whose partner of more than 30 years is hospitalized; the woman is unable to sign a consent form for emergency surgery because she is legally not a spouse or family member.

A real-life version of this tragedy triggered public outcry and reinvigorated support for marriage equality. On Oct. 16, 67-year-old French professor Jacques Picoux fell to his death from the top of a 10-story building in Taipei, police said. He is thought to have committed suicide after depression caused by the death of his partner due to cancer; Picoux was unable to make medical decisions for his partner in his final days, as Picoux had no legal status. In a response to this outcry, legislators from the DPP and the KMT, as well as the caucus of the New Power Party (NPP), a young activist organization, all introduced similar marriage equality bills.

All three proposals would amend the Taiwan Civil Code to open marriage to same-sex couples, but they differ in how to do so. DPP legislator Yu Mei-nu’s proposal introduces a general provision extending to same-sex couples the right to marriage, as well as other family law rights that accompany married status. But it leaves further gendered language across the civil code intact. The proposals of KMT legislator Hsu Yu-ren and the NPP would make references to “husband and wife” and “father and mother” gender-neutral throughout all relevant civil code provisions. These latter two proposals have great symbolic meaning, because they remove a heterosexual presumption from the code, but the legal effect is likely no different than Yu’s proposal.
這三個提案都主張修改民法將婚姻制度對同性伴侶開放,但對於如何開放則各有其詮釋。民進黨尤美女的版本採用一概括條款(註:新增民法971-1條)使同性配偶適用夫妻、父母子女等相關權利義務,但保留了民法中「性別化」的法律用語,未加修改。國民黨立委許毓仁與時代力量黨團的版本則將「夫妻」、「父母」等現行民法中的用語性別中立化。許毓仁與時代力量的版本,將異性戀預設的用語「性別中立化」而具有重大的象徵性意義,但若在法律適用結果而論,三個版本並無太大差異。
There is still a long legislative road to travel before Taiwan can become the first Asian government to legalize same-sex marriage. The bills passed their first reading on Nov. 17, but the DPP caucus whip has said the proposed bills will next be reviewed on Dec. 26. During the review process, any legislator can introduce a competing same-sex partnership act. Even if the bills were to enter a second reading, they could still face a boycott and be removed from the agenda. The bills will only become legislation after passing three readings.

Opposition to marriage equality in Taiwan largely comes from small but well-organized and vocal conservative religious groups. Four people reportedly even managed to storm into the legislative meeting room, shouting that the “legislators are monsters” and would want to change Taiwan “into an AIDS island.”

(The NPP caucus fully supports its bill but only holds five seats in legislature.) Tsai has reiterated that the bills are “clear evidence” marriage equality has support across all parties. But even Yu, who introduced the DPP bill, says she is only cautiously optimistic about the chances of passing a marriage equality law.
台灣伴侶權益推動聯盟理事長許秀雯表示,現在沒有辦法預知立法院是否會通過婚姻平權法案,情勢走向如何,真的很難說。因為主要政黨國民黨及民進黨的立委雖然都有提出婚姻平權民法修正案,但這兩個黨裡面也都有反對者(時代力量雖然全黨都支持婚姻平權,在立法院內也只有五個席次)。蔡英文總統數度表示,不同版本婚姻平權法案的推出,即為此議題獲得跨黨派支持的「明證」。然而,即便是推出民進黨版本婚姻平權法案的尤美女立委也表示,對於婚姻平權是否能過關成為法律,她仍只抱持審慎樂觀的態度。
Outside lawmakers’ offices, the battle for public support continues. If anything, it seems to be waning precisely at the time when it will be most needed. “More and more people are confessing that they love gays but that they don’t support same-sex marriage,” said Ko, because they believe allowing same-sex partners to get married will harm traditional family values. She is therefore unsure whether Taiwan will manage to pass a bill in the next year. At least, Ko added, “people are talking [about it], and it is not a taboo anymore.”
在立法委員的辦公室外,爭取民意支持的戰爭仍未停歇。若真要說,此時此刻婚姻平權運動最需要的是什麼?大概就是更多的支持。女人迷總編輯柯采岑表示,「有越來越多人坦白表示,他們愛同志但是不支持婚姻平權」,因為他們認為,若同性伴侶可以結婚,將損害傳統家庭價值。」她也說,不確定臺灣能否在明年內通過婚姻平權法案。她補充:「但至少,大家都開始討論(婚姻平權法案)了,這再也不是禁忌了。」
